legal experts fear implications of drone attacks

Legal experts expressed grave reservations Tuesday about an Obama administration memo concluding that the United States can order the killing of American citizens believed to be affiliated with al-Qaida — with one saying the White House was acting as “judge, jury and executioner.”

The experts said that the memo, first obtained by NBC News, threatened constitutional rights and dangerously expanded the definition of national self-defense and of what constitutes an imminent attack.

“Anyone should be concerned when the president and his lawyers make up their own interpretation of the law or their own rules,” said Mary Ellen O’Connell, a law professor at the University of Notre Dame and an authority on international law and the use of force.

“This is a very, very dangerous thing that the president has done,” she added.

The memo, made public Monday, provides detail about the administration’s controversial expansion of drone strikes against al-Qaida suspects abroad, including those aimed at American citizens.

Among them were Anwar al-Awlaki and Samir Khan, who were killed by an American strike in September 2011 in Yemen. Both men were U.S. citizens who had not been charged with a crime.

Attorney General Eric Holder, in a talk at Northwestern University Law School in March, endorsed the constitutionality of targeted killings of Americans provided that the government determines such an individual poses “an imminent threat of violent attack.”

But the memo obtained by NBC News refers to a broader definition of imminence and specifically says the government is not required to have “clear evidence that a specific attack on U.S. persons and interests will take place in the immediate future.”

“This is a very, very dangerous thing that the president has done,” she added.

I have expressed this in other threads, but once again, here it is. These people gave up their Constitutional protections when they left the US and joined forces with the terrorist organizations. All of you Viet Nam vets, would probably agree that if the same technology had been available you'd have loved it if Jane Fonda and her merry band had been taken out in the same manner during their renown visit to Hanoi! I fully believe that the US military has every right to target American traitors when they are participating in planning and organizing terrorist activities while living in a foreign country among terrorists intent on killing Americans. Al Awalki was shown on Al Jazeera and other news organizations promoting the killing of American citizens both at home and abroad. He and Khan got exactly what they deserved! We also have to remember that both of them, as well as others; denounced their American citizenship and considered themselves as members of Al Quaeda.

This is the part that truly has me worried.

So who determines this criteria. Are law abiding gun owners in this country all of a sudden going to be deemed an imminent threat of violent attack?

They discussed this on the news last night, and one of the speakers noted that this "drone attack" philosophy could "legally" allow other countries to hit an expected threat on US soil if they gain the technology. It's not like some of these suicide bombers would not volunteer for that position...

That's the biggie ain't it ? Who gets to decide who is the threat ? If this is allowed then it will only be a matter of time before it is authorized to be used here on our own soil.

as i have said many times, they do this in baby steps! bombing on u.s. soil is coming! thats what thier working up too! barry knows he will have issues with certain people, will be just to easy to drop 1 on them and scream terrorist!!
