Without seeing the actual picture... I cannot see how holding a child and a BB gun is child endangerment!!!  If the baby was not holding the gun, or the gun pointed at the child how can this be!!!

If he had a circular saw in his hand and holding a baby.. would he be arrested?

With out seeing the picture .But as stated the gun was pointed at the floor .Government out of control.

The pic is shown in the links at the bottom of the page. It looked pretty harmless to me.

It may not have been the brightest thing to do, but he was not threatening the baby.. Hell! Micheal Jackson hung his kid over a balcony and was not charged!!!

I think the most telling comment was "Gaines ex-wife saw the photo and reported it". Could be just some sour grapes from her.

Child custody it sounds like .Just make him look bad .

I think it is just the ex wife being a worthless b**tch and causing trouble and an over eager police force/da trying to make a name for themselves.

Yep ! An ex can cause a man more problems than one can count. Mine lied on two occassions and I had to go to jail and then in court proved she had lied and the second time it finally caught up with her. It cost the woman who was the head of the Blue Ridge Jucdicial Circuit's Child Support Recovery her job. When it was proven that she and my ex had lied she was gievn the choice of staying in Ga and going to jail or resign and leave the state and she chose to leave the state. My ex was then told that if I wanted I could have her jailed and she begged, pleaded, and swore she would never bother me again. When the judge asked me what I wanted to do I told him I simply wanted it to all be over and to never have to deal with her again. It was done and she signed the papers and I have not had to deal with her since. The sad part is that anyone can go to the local LE and lie and pay $40.00 and have a warrant issued for anyone. Then the warrant is served and the person is jailed, has to make bond, hire a lawyer, and then go to court and prove they are not guilty all the while the one who lied and had the warrant issued only has to say they were mistaken and they walk without any repercussions. Of course the person arressted can then take them to civil court but that only cost more money for a lawyer and then the time going back and forth to court. But I am glad to say that the laws have changed a lot for the better here.

Actually he isn't married to the baby's mother, and it was the baby's grandmother who called the cops and filed the complaint. The mother and grandmother are both white, and of course the father is black, which may be part of the "friction" between the father and the grandmother. The baby's mother can't even speak proper English, so it's evident that she's white trash in the first place, then the appearance of the father speaks of punk azz hoodlum, so consider the situation.
