Does SB 798 mean anything to you? If you enjoy your Second Amendment rights, then you should probably be familiar with it—and take action!

I’m not big into shooting airguns (airsoft, BB guns, etc.) these days. Frankly, I’m limited on time, so when I have the chance to go shooting I prefer the real thing. But like most kids, when I was younger I had a BB gun that I shot regularly. Before that I “played guns” with neighborhood friends. We would run around with our toy guns and let our imaginations go wild … like kids do.

One afternoon, we were playing guns and decided to climb to the roof of my parents’ garage. If I remember right, I think we were “soldiers” that day, pretending to be positioned at a “lookout station.” Before we knew it, there were other “soldiers” surrounding us on the ground—except they were quite real and wearing badges. A neighbor across the alleyway called the police, insisting we were shooing her garage door with our “BB guns.” The police quickly realized our guns were merely gun replicas aka toys—not BB guns. Needless to say, I didn’t play guns in public much after that.

Luckily, at that time we were obviously kids in broad daylight with toys. For the boys in blue, there was really no mistaking us for potentially serious criminals with real BB guns, or firearms for that matter. A 13-year-old California boy (who stood nearly 6-feet tall and weighed 200 pounds) wasn't so lucky last December; he ran from police officers and, when cornered, pulled out a BB gun that looked identical to a Beretta 92FS. One of the officers shot and critically wounded the boy.

What if the boy’s gun would have been clear? How about bright redpurple or another “bright” color? (Note: Those guns I just linked to are firearms, not BB guns or airsoft guns.) Would the officer have shot the boy? Would the officer have dismissed the handgun as a replica and let his guard down? I guess a better question is, if someone pulled a gun on you, would you let your guard down and refrain from protecting yourself if the gun was “…white, bright red, bright orange, bright yellow, bright green, bright blue, bright pink, or bright purple, either singly or as the predominant color in combination with other colors in any pattern…”? What if it was dark out?

California Senator Kevin de León seems to think bright coloring of replica handguns will protect police officers and innocent bystanders. Here’s the shocker that'll leave you in a state of disbelief (maybe): He’s backed by Los Angeles law enforcement officials and several others. Here's a glimpse at the main guts of the bill:

 

Senator de León’s bill, SB 798,  has already passed through the California State Senate, and is now on its way to the seven-person California State Assembly Committee on Public Safety.

Yes, if this bill passes and becomes a law, the airsoft and airgun industries will suffer greatly. More importantly, the thousands of folks who enjoy airsoft and airgun sports will suffer. Most importantly (let’s read between the lines), bills like this are one more gateway for anti-gun politicians and other special interest groups to weasel their way into firearm regulations—hence the reason I brought up your Second Amendment rights in the first paragraph.

Here are a few key points to pay attention to when speculating about SB 798:
- SB 798 will not protect police officers or innocent bystanders; it will in fact have an opposite effect by providing false security. (Brightly colored firearms—not just BB guns or airsoft guns— do exist!)
- SB 798 will put lawful airsoft and airgun owners under the same umbrella as criminals.
- SB 798 will put airsoft and airguns into the same category as other “gun replicas” aka TOYS. Airsoft and airguns are not toys, and shouldn’t be considered toys by any means.
- SB 798 would negatively affect sales in the airsoft and airgun industries, thereby harming our economy.
- SB 798 author, Senator Kevin de León, cited Wikipedia as a reliable source of information in the draft of the bill—enough said.

Currently, the California State Assembly Committee on Public Safety hearing for SB 798 is scheduled for June 28, 2011.

Here are a few easy ways you can put a stop to SB 798:
- Fill out this petition form provided by Pyramyd Air. They'll do the rest for you.
- Download, sign, then mail or fax this letter to Senator de León (see detailed instructions on the page).
- Call the seven members of the California State Assembly Committee on Public Safety and express your concerns.

(Note: I have already taken advantage of the first option provided by Pyramyd Air.)

The second amendment should not be toyed with in any way, it is the best insurance that we will be capable of staying free and it does not matter what the other side of the arguement says.

This country was founded on principles that are being stripped everyday by those who are elected to protect those rights. Take back your Country and vote them out! Look at what they have done and not what they say.

the government keeps taking and taking. whats to stop someone from painting their gun a bright color and using it in a crime .this stuff is just more burrocratic BS,. (i know i misspelled it was intentional).
they are all asses. only cops and crooks have guns? there are not enough cops out there to protect us all now.we have to protect ourselves at times.many years ago break ins were few and far between,why, because you didnt know what was on the other side of that door or window.now the criminals know this and are rampant in it now.
KEEP US FREE AS OUR FOREFATHERS DID.
NOT AS YOU THINK WE SHOULD BE NOW.

The purpose of this bill is to protect police officers and to keep civilians from being shot by them. Why is this a problem? What is wrong with having brightly colored toy guns (and yes we are talking about toy guns here). I know its change and change is inherently "bad", right? Is that really the only argument you guys have?

JWATSON:
Do you believe felons should have access to firearms? Isn't keeping guns out of the hands of convicted criminals a violation of the second amendment? It isn't mentioned specifically is it. What about people who have been deemed legally insane?

Please be more specific regarding your claims. Just what "principles" are being "stripped"? I require more information than your parroted TB'er nonsense.

mgrissman:
Why would a criminal paint his gun and then use it to commit a crime? It doesn't make any sense. Neither does your non sequitur argument of fewer police officers => criminal knowledge => more break-ins are committed because "they know this and are rampant in it" (?). Last I checked, people still own guns, nobody has taken that right away (contrary to popular belief).

Just what "rights" are being lost here? The right to own toy guns? No.

Your sections on "things to pay attention to when speculationg about [the bill]" are just that, speculations.

How exactly would the bill "put lawful airsoft and airgun owners under the same umbrella as criminals"? I read the bill, it doesn't. It only concerns future sales, not past sales. It doesn't make any currently owned toy guns illegal.

Do you even live in California?

#dtbrantner It people like you that dont see what they have done to our rights in states like California that set precidence in other states. Look at what legislation like this has already done. When will you people see that this is how they strip rights away is introducing legislation that is for our own good and then it gets miss lead and read by attourneys and judges and they set the precident for cases going forward. Sad that your to stupid to see that.

In regards to your last post, what exactly has legislation like this already done? Again, I'm just looking for clarification of your generic blanket statements.

no one said you were stupid .everyone is entitled to their opinion.they start out by making toy guns brightly colored.then the crooks or WHOEVER, start painting there real guns brightly colored now because of this, they could ban all guns, because they cant tell the differance.ONCE THE NAME CALLING COMES OUT,YOU CAN CLARIFY YOURSELF ,IM NOT INTO CHILDISH JIBBER.

If an officer shot a kid with a red tip soft pellet toy what is this stupid bill going to do to prevent stupid. I think the cops need a little more training or taken out of the policeman line of work. And if the only thing politions have to do is dream up stupid laws like this with our country in the state it is in now. They need to be removed from there public service job!! I don't care if you paint these guns glow in the dark it would not help prevent bad judgement buy some lawenforcement people. I would be willing to bet if they would just enforce the laws they now have on the books there would be no need for this stupid BS.
I am not from your state. And if I did live in your state it would be a place to be F R O M. These laws you creat in your state afect every state in the union. AND I DON'T LIKE YOU PLAYING WITH MY FREEDOMS!!! I live in SD the land of the hard working freedom loving people. That know what an imatation gun looks like and are tought that in a young age a BB guns is to be treated with respect and used correctley. Don't shot yourself in the eye Calif. Or in this case in the foot.

Just another prime example of how government is having to step up and try (use the word loosely) to do our jobs as parents for us. Somebody (namely parents) should teach their kids to respect law enforcement and if they have a "toy or BB gun" to put it down as quickly as possible to let the police officer know that there is no threat to him. I used to play army in my neighborhood and had local police get called on me a few times. I was always very quick to put down my "toy" gun and put my hands up where they could see them. I am not saying that all cases are like the one in the article above, but if I was an officer and was CHASING a 6 ft, 200lb boy and he turned and started pulling a gun, I think I would have not given it a second thought about pulling the trigger. Although, I would have been heartbroken after it was all done knowing that I could have saved a life.
